complaint

We have recently had a serious complaint from Mr Beale of 12 phase 2 that the Communal pool had not been cleaned once during his recent 10 day visit, the dates he has yet to confirm.
In view of the amount of money we as a Community spend on maintaining the pool and the obvious risk to health should this be the case, we have to look in depth into this complaint.
A meeting is arranged between the Pool Maintenance Company, the Administration and the Officials here on Sol Golf this week.
Could any owner or guests who has any views on this complaint please get in touch with either us or the Administration as soon as possible please. In the meantime we have emailed every owner that we have an address for and will be visiting the apartments to speak with the families that are here on Sol Golf, as this will take some time please could all owners answer as soon as possible as we need this matter dealt with.

Sorry to hear that John is resigning at the end of the year,

reading the web site regarding the new president it makes no mention that the president has to be resident is this now not the case?

Regarding changing the administrator in view that most of the committee is resigning would it not be better to keep the existing one so that there is some form of continuity? also should policies not be made until a new committee is elected?

As I have mentioned to you on many occasions there are to many pool rules this is a holiday destination and as such people tend to have fun in pools. I have been to many destinations across Spain and the Islands and have never encountered so may do,sand dont,s at a swimming pool .

Would not a simple sign warning people that they use the pool at there own risk and that the community are not responsible for any loss or injury be sufficient?
As for the cleaning, a pool that gets as much use as this one during the summer needs attention 7 days a week when I was out recently for 10 days I did not see it cleaned once.
As for the Parking in driveways look no further than Vice President a serial culprit.

This email has been answered in depth and sent to Lez. It explains that under Spanish Law the only requirement to be President is to own a property on the Urbanisation and to be fully paid up with all Community charges.
We have never said that we are changing Administration, only that we are obtaining quotes for the whole of the Community of Owners to decide what THEY want to do. In addition, I explained that "policies"or indeed decisions are not made by the President of Committee but by the owners at the A.G.M. and acted on by the Officials in their own time and often at their own expense.
If Mr Beale knew anything about Spanish Law, which he obviously does not, he would know that the majority of the pool rules have to be in place to allow the pool to open and by order of our insurance policy. He would also know, if he had anything to do with running an Urbanisation the size of this one that the officials are more than aware that this is a holiday destination. It is us, not he, who has to put up with the bullies and thugs who come here for their holidays!
As I say Mr Beale knows nothing about Spanish Law and should any future President take down the pool signs that we have to display under this law, then I as an owner would require him/her to sign a disclaimer stating that he/she would be totally responsible for any injury/death claim and that the costs of such a claim would not come from any other member of the Community.
Lastly, as you can see from the email the statement "I was out for 10 days and did not see the pool cleaned once" has to be looked into in some depth. We have had a meeting with the Pool Company and the Administration and are also, as many of you know asking all owners, and their guests their opinions.
This is not only a slur on the Pool Companies reputation, it is an insult to the Officials, with the intimation that they Officials would let 10 days pass before they noticed the pool had not been cleaned!
Lastly, over the past three years the pool has been well maintained and has never needed to be cleaned daily. Of course Mr Beale can have this item on the next agenda, and of course the Community charge would need to increase should this unnecessary extra work be passed by the majority of the urbanisation.
We intend to publish the full list of comments on the pool as soon as possible

Dont think I ever said I knew about Spanish Law I just asked a Question

By they way I also have an other property in Spain on an urbanisation and that one is not blighted with rules and regulations like we have and suprise suprise they dont get half the problems we seem to get

I Dont think there is any need to Slag me off and to discredited my name Just because i dont agree with your policys

As for the pool I thought i made it clear I DID NOT SAY IT WASNT CLEANED I SAID I DIDNT SEE IT BEING CLEANED

You say that if the pool signage was taken down you would want the new president to sign a disclaimer I think this is an excellant idea and if you would kindly send me such a signed document.

As you say you have pool rules and in your own words on this site you say there is problems with Lilos and boats so I take it that no one on the commitee is inforcing such rules therefore as you say signage is not witheld under Spanish law we are in breach of terms & conditions under the insurance and as such would not have a claim, so please send me the signed disclaimer ASAP.
